TERMS OF SERVICE

Welcome to Monarch Detailing. These Terms of Service govern your use of the Monarch Detailing website and your purchase and use of products supplied by Monarch Detailing.

By accessing our website, placing an order, or otherwise using our services, you agree to these Terms of Service.

Please read these Terms carefully before using our website or purchasing any products.

1. GENERAL

Before using any chemical or detailing product, customers should carefully read all applicable:

Instructions;
Labels;
Warnings;
Dilution recommendations;
Application instructions;
Safety information; and
Product-specific limitations.

Products must not be used for purposes for which they were not designed.

Monarch Detailing is not responsible for damage caused by incorrect use, misuse, negligence, inappropriate application, incorrect dilution, unsuitable surfaces, incompatible materials, failure to follow instructions or use outside the intended purpose, subject to any rights that cannot legally be excluded.

Customers are responsible for testing products on an inconspicuous area where appropriate before widespread application.

5. CHEMICAL PRODUCTS AND SAFETY

Certain Monarch Detailing Products may contain chemical ingredients intended for automotive cleaning, maintenance or detailing applications.

Customers are responsible for handling Products safely and in accordance with the applicable product instructions and safety information.

Customers should:

Keep Products away from children and animals;
Avoid unnecessary contact with skin and eyes;
Use appropriate personal protective equipment where recommended;
Avoid ingestion or inhalation;
Store Products appropriately;
Keep Products in their original containers where applicable;
Follow all label instructions and warnings; and
Dispose of Products and packaging responsibly.

Monarch Detailing is not responsible for injury, damage or loss resulting from misuse, improper storage, failure to follow safety instructions or use contrary to the Product's intended purpose, except to the extent that liability cannot legally be excluded or limited.

6. ORDERS

Placing an order through our Website constitutes an offer by you to purchase the selected Products.

An order is not necessarily accepted merely because you have received an automated order confirmation.

Monarch Detailing reserves the right to accept or decline an order where reasonably necessary, including where:

A Product is unavailable;
There is an obvious pricing or description error;
Payment cannot be verified;
We suspect fraudulent activity;
The order contains unusual quantities;
The delivery information is incomplete or incorrect; or
We are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been received, any refund required by applicable law will be processed accordingly.

7. PRICING

All prices displayed on the Website are stated in South African Rand unless otherwise indicated.

Prices may change without notice.

The price applicable to an order will generally be the price displayed at the time the order is placed, subject to obvious errors or applicable legal requirements.

We reserve the right to correct pricing errors.

Where an obvious pricing error has occurred, Monarch Detailing may contact the customer regarding the affected order and, where legally permitted, cancel the order and refund any amount already paid.

8. PAYMENT

Payment must be successfully received before an order is processed, unless Monarch Detailing expressly agrees otherwise.

We may use third-party payment processors to process payments.

Monarch Detailing does not directly store customers' complete payment-card information where payment processing is handled by an external payment provider.

Customers are responsible for ensuring that their payment information is accurate and that they are authorised to use the selected payment method.

9. SHIPPING AND DELIVERY

Monarch Detailing will make reasonable efforts to dispatch orders within the stated processing period.

Delivery times are estimates and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by:

Courier delays;
Weather;
Public holidays;
Strikes;
Road closures;
Incorrect customer information;
Failed delivery attempts;
High order volumes;
Customs or regulatory issues;
Events beyond our reasonable control; or
Other circumstances outside Monarch Detailing's reasonable control.

Once an order has been handed to the relevant courier, delivery is generally subject to the courier's processes and terms.

Customers are responsible for providing accurate delivery information.

Monarch Detailing is not responsible for delays resulting from incorrect or incomplete information supplied by the customer.

Nothing in this section limits any statutory consumer rights.

10. DELIVERY INSPECTION

Customers should inspect Products reasonably promptly after delivery.

If a Product appears damaged, incorrect or materially different from what was ordered, customers should contact Monarch Detailing as soon as reasonably possible and provide appropriate evidence, including photographs where requested.

Customers should retain the original packaging where a delivery-related claim is being investigated.

11. RETURNS AND REFUNDS

Returns and refunds are governed by our separate Returns & Refund Policy, which forms part of these Terms.

Our Returns & Refund Policy can be accessed through the Website.

Nothing in our Returns & Refund Policy or these Terms is intended to exclude or limit any consumer right that cannot legally be excluded under South African law.

12. CANCELLATION OF ORDERS

Where permitted by law, customers may request cancellation of an order before it has been dispatched.

Once an order has been dispatched, cancellation may no longer be possible and the customer may need to follow the applicable returns process.

Where a statutory cancellation or cooling-off right applies, that right will be handled in accordance with applicable law.

13. INTELLECTUAL PROPERTY

All content appearing on the Website, including but not limited to:

Logos;
Brand names;
Product names;
Photographs;
Graphics;
Designs;
Videos;
Text;
Product descriptions;
Website layouts;
Marketing materials; and
Other original content

is owned by or licensed to Monarch Detailing unless otherwise indicated.

You may not reproduce, copy, modify, distribute, publish, sell, license or commercially exploit our content without our prior written permission.

The Monarch Detailing name, logo, branding and associated intellectual property may not be used in a manner that suggests an unauthorised relationship, endorsement or affiliation.

Nothing in these Terms excludes, restricts or modifies any warranty, guarantee, condition or consumer right that cannot legally be excluded under applicable South African law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Monarch Detailing will not be liable for indirect, incidental, consequential or special losses arising from the use of our Website or Products.

This may include, where legally permissible:

Loss of revenue;
Loss of opportunity;
Loss of goodwill;

Monarch Detailing's liability will not be limited or excluded where doing so would be prohibited by law.

20. INDEMNITY

Discount codes cannot be duplicated or combined where prohibited;
Promotions may have expiry dates;

The remaining provisions will continue to apply to the extent permitted by law.

27. NO WAIVER

If Monarch Detailing does not immediately enforce a provision of these Terms, this does not mean that Monarch Detailing has waived its right to enforce that provision later.

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and any applicable consumer-protection mechanisms.

Nothing in these Terms prevents a consumer from exercising a right or remedy available under mandatory South African law.

29. ENTIRE AGREEMENT

These Terms, together with the applicable Website policies and any additional terms expressly incorporated into an order, constitute the agreement governing your use of the Website and purchase of Products, subject to mandatory applicable law.
